Terms of Service
1. Introduction
1.1 These General Terms and Conditions ("Terms") apply to all users ("Users") of the SOLED platform ("Platform"), where second-hand and new clothing can be traded.
1.2 By using the Platform, the User agrees to these Terms. If the User does not agree with the Terms, they must not use the Platform.
2. Definitions
2.1 "Seller": Any User offering clothing for sale via the Platform.
2.2 "Buyer": Any User purchasing clothing via the Platform.
2.3 "Transaction": The purchase agreement established between the Seller and the Buyer through the Platform.
3. Access and Use of the Platform
3.1 The use of the Platform is only permitted for persons aged 18 and older. Minors may use the Platform only with the consent of a parent or guardian.
3.2 Users must register with accurate, complete, and up-to-date information. Each User is responsible for keeping their account details confidential.
3.3 Users are not permitted to:
- a) Provide false or misleading information.
- b) Use the Platform for illegal activities.
- c) Disrupt the operation of the Platform.
4. Offers and Sales
4.1 The Seller is responsible for accurately and fully describing the offered clothing, including any defects or signs of use.
4.2 The Seller must ensure that all offered clothing items are owned by the Seller and free of any third-party rights.
4.3 The Seller is prohibited from offering counterfeit items or prohibited goods on the Platform.
4.4 The Buyer is responsible for checking the description of the clothing before completing the purchase.
5. Payments and Fees
5.1 Payments are processed through the payment methods designated by the Platform. The Platform may charge service fees, which will be clearly communicated to the User.
5.2 The Seller will receive payment after the Platform has confirmed the receipt of the clothing item and the inspection has been approved. The Platform may withhold a fee for services rendered.
6. Shipping and Delivery
6.1 The Seller is responsible for shipping the sold clothing item within the specified time frame.
6.2 The Buyer is responsible for providing accurate shipping information. The Platform is not liable for loss or damage resulting from incorrect shipping information.
6.3 The risk of loss or damage to the clothing passes to the Buyer upon delivery.
7. Cancellation and Return Policy
7.1 As a consumer, you have the right to withdraw from the agreement without giving any reason within 14 calendar days from the day you, or a third party designated by you who is not the carrier, physically takes possession of the goods.
7.2 To exercise the right of withdrawal, you must initiate your return through our return portal within the 14-day withdrawal period. You can find this via the link below:

7.3 After submitting your withdrawal, you have an additional 14 calendar days to return the goods to us. The costs for returning the goods are at your expense.
7.4 You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
7.5 Goods must be returned in their original condition and, if possible, in the original packaging, including all provided accessories and documentation.
7.6 Upon receipt and inspection of the returned goods, we will refund you within 14 calendar days. We will reimburse you using the same payment method you used for the original transaction unless expressly agreed otherwise with you.
7.7 We reserve the right to withhold the refund until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.
8. Liability
8.1 The Platform acts solely as an intermediary and is not liable for any direct or indirect damages arising from Transactions between Buyers and Sellers.
8.2 The Platform is not liable for content posted by Users, including but not limited to descriptions of clothing, photos, and reviews.
9. Privacy
9.1 The Platform processes personal data of the Users in accordance with applicable privacy legislation and the Platform's Privacy Policy.
10. Changes to the Terms
10.1 The Platform reserves the right to change these Terms at any time. The amended Terms will be communicated to Users and will take effect upon publication on the Platform.
11. Applicable Law and Disputes
11.1 These Terms are governed by Belgian law.
11.2 Disputes arising from or related to these Terms or the use of the Platform will be submitted to the competent court in Belgium.
